Charles E. Nichols, Jr.

Chuck represents developers in all stages of commercial and mixed use real estate projects, including choice of entity and ownership structure issues, acquisition and sale contracts, due diligence, loan documentation and closings. He also negotiates and prepares commercial leases and construction contracts.  

Chuck also represents lenders and serves as a substitute trustee in foreclosure matters.

Representative Experience

  • Negotiated and closed the acquisition and sale of office, retail and industrial properties
  • Created the legal structure for a high-density mixed residential, commercial and office use project, including the creation of a condominium regime, ground lease and master protective covenants to accommodate and govern the rights and obligations of different types of owners
  • Structured and documented office and land condominiums
  • Negotiated and prepared numerous commercial office leases
  • Provided general counsel representation to several developers and to small and medium-size businesses.

Amanda is a NC State Bar Certified Paralegal and has worked with Chuck since 2001 on all aspects of commercial real estate including:

  • Acquisitions including drafting purchase agreements and closing statements, title work, title and survey review, entity formations; and coordinating all aspects of closing
  • Sales of real property including drafting seller documents and coordinating closing
  • Leases - initial drafts of leases and amendments
  • Title work and preliminary title opinions for title company clients
  • Foreclosure work including coordination of foreclosures, drafting pleadings, proper service, and title work
